Acceptance and Governing Terms

These Standard Terms and Conditions shall apply to all sales of WattLogic, LLC (“WattLogic”). As used in these Terms  and Conditions, “we” and “our” shall refer to WattLogic. Unless otherwise specifically agreed in writing by an authorized representative of WattLogic, any different or additional terms and conditions proposed by and/or contained in a purchase order, response to a quotation, or other proposal are hereby rejected by WattLogic and shall not be incorporated into the agreement for sale of WattLogic’s products. Assent to these Terms and Conditions shall be conclusively presumed from an order of WattLogic products. If WattLogic is found to have acknowledged a buyer’s order or proposal, and such acknowledgment constitutes an acceptance of an offer, such acceptance is expressly made conditional on buyer’s assent to these Terms and Conditions, which shall form part of the acknowledgment, and acceptance by the buyer of any products shall be deemed to constitute such assent. If any quotation or other document of WattLogic is deemed to constitute and offer, the buyer’s acceptance of such offer is limited to these Terms and Conditions

Terms of Payment

Standard payment terms are as follows: Customer will receive a quote for the item(s) specified and will signify agreement by agreeing to the quote. If the quote includes a charger, Customer will purchase the charger and it will ship to the Customer’s home. If the quote is for labor and services only, the Customer will pay a refundable deposit. The installation will be scheduled and conducted at Customer’s location and upon completion, the remaining balance, including any change orders will be due. If Customer elected to store a payment method in Stripe, the balance will be charged to the customer’s Stripe payment method. All invoices are due upon receipt. Authorization and administration of payment will be facilitated and handled by Stripe and are subject to its terms of use (https://stripe.com/legal/spc). Should the information provided be missing, incorrect, or lacking detail, a change order may be provided to complete the installation.  Any rebates or incentives offered by third-parties are not guaranteed. Any rebates or incentives will be submitted and processed by Customer. WattLogic does not represent or guarantee any incentive or rebate. The information WattLogic provides on incentives and rebates is based on third party information and subject to change without notice and subject to the third party’s requirements and conditions. A service charge of 1.5% per month (18% per year) will be charged by WattLogic on any balance which is beyond the due date. Should it be necessary for WattLogic to institute formal proceedings to collect any past due amounts, WattLogic shall be entitled to recover its attorney’s fees and other costs associated with the proceedings. Notwithstanding the acceptance of an order by WattLogic, we reserve the right not to ship product to a party not paying in accordance with our terms or who, in the sole opinion of WattLogic, may be unable to meet its payment obligations.  

Order Cancellation Terms

WattLogic will accept order cancellations only if the cancellations are sent to WattLogic in writing ([email protected]) and received prior to manufacturing or shipment of the order(s) affected. Verbal cancellation of orders will not be accepted.

Shipping Dates

When an item is shipped directly to the Customer. Shipping dates are approximate and are based on the conditions existing at the time of WattLogic’s receipt of buyer’s firm order and all other information necessary to complete the order. WattLogic will take all reasonable steps to ship by the estimated shipping date but it shall not be responsible for any delay in shipment or any claims or damages arising therefrom. If product arrives damaged, note the extent of damage on carrier’s paperwork prior to accepting the package, photograph the damage, and report it to WattLogic immediately.  

Changes in Product Design or Discontinuation of Products

WattLogic reserves the right at any time and without notice to change, discontinue or modify the design and construction of any of its products. WattLogic may also substitute material equal to or superior to that originally specified.

Warranty

WattLogic warrants its products in accordance with the terms, conditions and limitations of its limited warranty policy. Please refer to the included warranty, which may be modified from time to time by WattLogic. For transactions when installation is purchased, the price for installation is estimated based on the information provided by you. A licensed contractor will perform the installation and provide a minimum of a 1 year workmanship warranty in accordance with state or local law. The warranty period begins on the date that the installation is completed as recorded in the WattLogic system. The workmanship warranty shall meet the minimum requirements of the state or local governing board of contractors. The Customer is responsible for regular maintenance and the electrical infrastructure of the installation location. Any owner neglect, modifications, or abnormal use may void all warranties. Products are covered by a manufacturer’s warranty and are dictated by the terms and conditions of the manufacturer. WattLogic does not administer, control, or own the warranty. When applicable, WattLogic will facilitate the paperwork necessary to complete the warranty with the manufacturer.

Limited Warranty. WattLogic Limited Warranty

Subject to the terms and conditions below, WattLogic, LLC (“WattLogic”) will file warranty claims directly with the manufacturer on the customer’s behalf as long as the product is within manufacturer’s warranty period; any labor or installation required for both the removal and replacement of said product will be the sole responsibility of the customer. The Limited Warranty is conditioned upon the normal and proper use and maintenance of the product. THE FOREGOING LIMITED WARRANTY IS EXCLUSIVE AND THERE ARE NO OTHER EXPRESS OR IMPLIED WARRANTIES (EXCEPT AS TO TITLE) MADE OR OFFERED BY WattLogic, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Voltages

All voltages at the location for which the proposed system is to be installed are assumed to be between 120 volts and 277 volts, unless specifically noted. If facility voltages vary from that, customer is responsible for all costs associated with correcting the voltage of the location or fixture. 

Federal Tax Credit

WattLogic is not providing any tax advice. To determine eligibility for any federal, state, or local tax credits, please consult a tax professional. The tax calculation shown on your proposal may include the federal tax credit related to IRS form 8911. The tax credit is 30% of the charger and installation cost, up to $1,000.

Utility Incentives

The incentive amount is an estimate and is governed by the terms and conditions of the utility program and Customer’s relationship with the utility. The utility may change or cancel funding or terms of a program without notice to WattLogic or Customer. Customer is responsible for determining eligibility, requirements, and for all aspects of the application process for the incentive. Customer may request required documentation from WattLogic to complete an application. For details on the program, the application process, and other requirements, Customer should contact its utility. When applicable, a link to the program is included on Customer’s quote.
